The PROMIS Software Scandal

The PROMIS software scandal is one of the most sprawling intelligence controversies of the twentieth century. It involves a small Washington D.C. software company, INSLAW, and the theft of its Prosecutor's Management Information System (PROMIS) software. This scandal touched nuclear weapons labs, foreign governments, and involved a media mogul found dead in the Atlantic Ocean.

INSLAW, founded by Bill and Nancy Hamilton in the early 1970s, developed PROMIS into a sophisticated case management tool. By the early 1980s, it was considered one of the most advanced data management systems. The Department of Justice contracted with INSLAW in 1982 to deploy PROMIS across U.S. Attorneys' offices. However, a U.S. Bankruptcy Court judge ruled in 1987 that the DOJ had 'stolen PROMIS through trickery, fraud, and deceit,' taking the enhanced version without compensating INSLAW.

The domestic theft was only the beginning. In February 1983, Rafi Eitan, an Israeli intelligence operative, visited INSLAW under the alias Dr. Ben Orr. He left with a copy of PROMIS. Eitan, known for capturing Nazi war criminal Adolf Eichmann, was the director of LAKAM, an Israeli scientific intelligence unit. He was also the handler for Jonathan Pollard, the American naval intelligence analyst convicted of spying for Israel.

Rafi Eitan and the NUMEC Affair

Eitan's involvement in U.S. affairs dates back to the NUMEC affair in the mid-1960s. A nuclear processing facility in Apollo, Pennsylvania, reported a significant discrepancy in its inventory of highly enriched uranium. Estimates of the missing uranium ranged from 200 to 300 pounds, enough for multiple nuclear weapons. Declassified reports and investigations suggested Israeli intelligence was behind the diversion, with Eitan visiting the facility in 1968.

The New York Times referenced Eitan's alleged role in the uranium theft in his obituary, though the paper faced criticism for presenting the allegations as fact. While Eitan's visit to the facility is undisputed, the fate of the uranium remains unresolved.

The PROMIS Backdoor

After obtaining PROMIS, Eitan tasked his intelligence network with modifying it. Ari Ben-Menashe, a former Israeli military intelligence officer, claimed that Israeli operatives engineered a backdoor into the software. This covert trapdoor allowed Israeli intelligence to remotely access any system running PROMIS, without the user's knowledge.

PROMIS was designed to integrate and cross-reference massive databases, making the implications of this backdoor staggering. Any entity using PROMIS would effectively provide Israel with a live feed into its most sensitive data, visible in real time from Tel Aviv.

Robert Maxwell's Role

The distribution of the weaponized PROMIS software was facilitated by Robert Maxwell, according to investigative author Gordon Thomas and other sources. Maxwell, born Ján Ludvík Hyman Binyamin Hoch in Czechoslovakia, was a powerful media proprietor by the 1980s. He owned the Daily Mirror and was deeply involved in selling PROMIS to various governments and organizations.
